Conduct Incident Reporting Process

  1. Staff and/or faculty reach out to their direct report to determine whether there needs to be action taken.  The area manager/dean will advise if the alleged should be removed from the area.  For faculty, a determination can be made to remove the student for up to two consecutive class periods.  For other areas of campus, immediate removal can be determined with a request to not return for up to two days.
  2. Faculty/Staff/Manager will file a Conduct Incident Reporting Form to alert the Conduct Officer of a potential violation.
  3. If the incident involves potential Title IX violations, the Conduct Officer will notify the Title IX officer and await further instructions before beginning the Conduct investigation.
  4. If the incident is conduct, or if the Title IX officer clears the case for conduct, the case will be opened in Maxient and the investigation will begin.
  5. Each case is updated with tasks assigned to ensure compliance with deadlines according to the AP 5520 Procedures.  The investigation allows for due process including a 10-day window for responding to the conduct notice by the alleged.
  6. The Conduct Officer will review the Case and determine next steps:
    1. There is no valid case or it is strictly an FYI filing – case is closed or withdrawn.
    2. Valid case or concern:
      1. Conduct Notice Letter is sent to student within 10 days of receiving the incident report along with a copy of AP5500 and AP5520
      2. If police were called to deescalate, dispatch will be copied on the letter
      3. Student has option to meet with the Conduct officer and must reply no sooner than 3 days after receiving the letter
  7. If students do no open their notice letter, attempts will be made to call, text or email the student further to ensure they see the letter up to 10 days following initial mailing of the notice.
    1. All attempts at contact will be noted in Maxient.
  8. If the student elects to meet, the Conduct Officer will remind students of their rights and responsibilities as a Delta College student, their right to due process, and will also review the content of the incident report.
  9. The student will be given a chance to respond verbally or in writing to the accusation.
  10. They will also be advised of the right to appeal any outcome determined following the investigation.
  11. Conduct Outcome Letter will be sent after the meeting and concluding the investigation or if the student does not respond to the Conduct Notice within 10 days of the initial Conduct Notice Letter.  If campus police were called to de-escalate the situation or if the outcome results in a suspension, dispatch will receive a copy of the outcome letter.
  12. If the student does not pick up the letter, attempts will be made to contact the student to alert them, or a letter will be delivered to the student by campus police.  All attempts will be noted in Maxient.
  13. The appeal process is governed by AP 5520 and will be conducted by a Hearing Officer and Committee.
